Wayne Gross, a former federal prosecutor who now defends white-collar cases for Greenberg Traurig in Irvine, said the Department of Insurance has a team of investigators who work with federal and state prosecutors to bring criminal charges.

Prosecutors, either with the county district attorney’s office or U.S. attorney’s office, ultimately decide whether to file charges, said Gross, who as a federal prosecutor handled a fraud case that was investigated by the Department of Insurance.

Wayne Gross Featured in Daily Journal Article – Developer Wins Big Award

Greenberg Traurig Partner, Wayne Gross, and fellow partner, Alan Greenberg, are featured in a Los Angeles Daily Journal article about their $50 million victory for a Newport Beach real estate developer.

Newport’s lawyers at Greenberg & Traurig convinced the jury that Commonfund Realty Investors LLC rescinded a joint venture to renovate the Palladium and build several high-rise hotels and office, condominium and retail buildings. After a four-week trial, the jury last week awarded $16.3 million in compensatory damages and $33.9 million in punitive damages, finding Commonfund breached its fiduciary duty. Orange County Attorney Wayne Gross was quoted in a Wall Street Journal story about backdating defendants who are complaining over alleged prosecuctorial misdeeds.

“Defense lawyers often assumed that coercive tactics by prosecutors and agents, though repugnant, would be overlooked by judges if ever brought to their attention. So defense lawyers let it go,” said Wayne Gross, former chief of the U.S. attorney’s office in Santa Ana, who now practices white-collar defense with the Irvine office of law firm Greenberg Traurig.

Orange County Attorney Wayne Gross commented on KB Home CEO Bruce Karatz’s defense accusing federal prosecutors of manipulating witnesses in his upcoming option-backdating trial.

“What happened in Broadcom will cause defense lawyers to pursue these misconduct allegations because for the first time there’s a possibility such arguments will be heard and acted upon by judges,” said Wayne Gross, former chief of the U.S. attorney’s office in Santa Ana, who now practices white-collar defense with the Irvine office of law firm Greenberg Traurig.
